Abstract
In Indonesia, there are two systems for financial institutions. The conventional financial
institution adheres to the law of engagement as laid down in the book of private laws (KUH
Perdata). The Sharia financial institution, on the other hand, upholds Islamic ways of transactions
sourced from al-Qur'an and al-Hadits. This article attempts to find out whether the two sources
of laws, the secular KUH Perdata and the Islamic holy texts, have things in common.
