Abstract: In this this article, I discuss the constitutional debate in 1945 on the conceptions of
religious freedom and its relation to sharia. I argue that the framers of 1945 Constitution wanted
the application of shariah within the limits of individual freedom of Muslims and non-Muslims.
They agreed it would apply only to Muslims. However, they, particularly, secular groups set
non-coercive measures as a limit for state authority in the application of shariah. They preferred
the state not enacting policy or law that has the intention or effect of coercing Muslims to practice
sharia, particularly in the area of human relations with God.
Abstrak: Dalam artikel ini, saya mendiskusikan perdebatan konstitusional pada tahun 1945 tentang
konsep kebebasan beragama clan hubungannya dengan syariat Islam. Saya berargumen bahwa
para perumus U ndang-undang Dasar 1945 menginginkan penerapan syariat dalam batas-batas
kebebasan individual warga Muslim clan non-Muslim. Mereka setuju bahwa penerapan syariat
hanya berlaku untuk Muslim. Namun mereka, khususnya kelompok sekuler, menginginkan negara
menerapkan hukum Islam dengan tanpa kekerasan. Mereka lebih memilih agar negara tidak
membuat kebijakan atau aturan yang bertujuan atau yang mengakibatkan pemaksaan terhadap
Muslim untuk melaksanakan syariat, khususnya dalam urusan hubungan manusia dengan Allah.
